'nexrastore' is a trading name of PurpleLilac Ltd, a company registered in England and Wales (company number 7106005) whose registered office is at 7 New Lydenburg Commercial Estate, London, SE7 8NF, England.

This Website is owned and operated by PurpleLilac Ltd where all content, contract and communication will be concluded in English.

Unless stated otherwise, the terms "nexrastore", "we" and "us" on this page refer to 'nexrastore' (including throughout the Website Terms and Conditions and the Terms and Conditions of Sale).

These terms and conditions ("Terms and Conditions") apply to your use of the nexrastore Website at www.nexrastore.com (the "Website"). You must read these Website Terms and Conditions carefully, you may want to print and keep a copy for your future reference. By accessing, browsing, using or registering with the Website, you confirm that you have read, understood and agree to these Terms and Conditions in their entirety. If you do not agree to these Website Terms and Conditions in their entirety, you must not use this Website.

We reserve the right to change and update these Website Terms from time to time and recommend that you revisit this page regularly to keep informed of the current Website Terms that apply to your use of the Website. By continuing to access, browse and use this Website, you will be deemed to have agreed to any changes or updates to our Website Terms.

If you order a product through the Website, our General Terms and Conditions of Sale will apply (see below). Please also note that when you agree to our Terms and Conditions you shall be deemed to have read, understood and agreed to our Privacy Policy in its entirety.

These General Terms and Conditions of Sale are governed by English law. In the event of any matter or dispute arising out of or in connection with these General Terms and Conditions of Sale, you and we shall submit to the exclusive jurisdiction of the English courts.

General Terms and Conditions of Sale

Product Descriptions

nexrastore will reasonably attempt to ensure that prices quoted on the Website are correct and that all products are fairly described. However, when ordering products through the Website, please note that:

  • You must be over 18 years of age to place an order on this website.
  • Orders will only be despatched if there are no material errors in the description of the goods or their prices as advertised on this Website.
  • nexrastore reserve the right to cancel, refund or refuse orders for items offered at an incorrect price or specification.
  • Where it is not practical or beneficial for nexrastore to do so, we reserve the right to refuse orders at any time, even if we have fulfilled them previously.
  • All prices are displayed in GPB (pounds sterling) inclusive of UK VAT, where applicable, unless expressly indicated otherwise.
  • Where pictures may show multiple products for marketing purposes, only one product will be despatched unless otherwise expressly stated.
  • Outer appearance and packaging may vary from that shown.
  • Weights, dimensions and capacities shown on the Website are approximate only.
  • Products made by hand and/or from natural ingredients and formulations may vary from batch to batch in consistency, viscosity and appearance.
  • Whilst we try to display the colours of products accurately, the colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.
  • All items are subject to availability. We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer alternative product(s) or service(s) of equal or higher quality and value.

 

Customers from outside the United Kingdom

Except where otherwise specified on this Website, the products on this Website are displayed solely for the purposes of promoting nexrastore products available in the UK.

We may accept orders for delivery to locations outside of the UK subject to customs, legal, regulatory and certain practical restrictions. Where it is not practical or beneficial for us to do so, we reserve the right to refuse orders from outside the United Kingdom at any time, even if we have fulfilled them previously.

Products are sold on a delivered duty unpaid basis. The recipient may have to pay import duty or a formal customs entry fee prior to or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are required to check these details before placing an order for delivery outside the UK.

Purchases will be made in pounds Sterling and inclusive of VAT where applicable. International credit card providers, banks or PayPal will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay.

If any package containing unopened items is returned to nexrastore because of non-delivery, we reserve the right to deduct 20% of the original product price for restocking and administration. Shipping costs are non-refundable. We do not accept returns on sale items. Please also note, if charges are levied for the packages' return, nexrastore will deduct any such costs from the value of the order before implementing the Returns Policy.

Returns Policy

For UK and EU customers, if you are returning an item due to error on the part of nexrastore, please notify us within a period of 7 days from the date you received your delivery and we will be happy to provide a replacement. We do not accept returns on sale items.

For non-EU customers, if you are returning an item due to error on the part of nexrastore, we will be happy to replace, however, you are responsible for all return shipping charges and we reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount if the goods are not in a resaleable condition. We do not accept returns on sale items.

Refund Policy

nexrastore sell personal grooming products, that is, product specifically designed to be used in direct and prolonged contact with skin and/or hair, therefore for health & hygiene reasons nexrastore cannot offer refund or exchange on any product (including those with tamper-proof seals) unless the product was faulty when we sent it to you.

Refunds can only be made to the original card of purchase unless the original account no longer exists or the original account details have expired, you will need to provide evidence of this. If you are unable to do so, a credit code for the refund amount will be issued.

nexrastore cannot offer refund or exchange on products;

  • which may have melted, spilled, spoiled or become either rancid or damaged due to temperature fluctuations (extreme or otherwise) which are beyond our control.
  • which may have melted, spilled, spoiled or become either rancid or damaged due to incorrect storage or handling by you.
  • that are unwanted or unused by you or ordered in error.

Missed Deliveries

Missed deliveries are returned to our warehouse. You will be sent an e-mail explaining options for refund or redelivery. Redelivery is chargeable.

Where your order has been returned to us because of non-delivery on your part (i.e. you do not respond to communication from the carrier company and/or you do not retrieve the order from the sorting office/post office) we reserve the right to deduct 20% from the selling price of the item(s) for restocking and administration.

For USA customers a $15.00 fee is charged by DHL if a manual search is conducted to find an incorrect address or unknown street which was supplied by you on the order.

We offer secure delivery services, therefore ALL deliveries must be signed for. If you wish to instruct our nominated carriers (DPD, DHL or Royal Mail) to leave your order in a specific location, e.g back of the house, behind a dustbin, where a signature cannot be obtained, this is entirely at your own risk and we take no responsibility for lost, stolen or damaged items. The original order will not be re-supplied or refunded.

Faulty Goods

In the rare event that a faulty product has shipped to you, we will be happy to refund or exchange. However, if the fault is due to damage to the parcel in transit, you must claim this from the postal service.

Please e-mail us to tell us about the faulty product you want to return and we will respond as quickly as possible.

Please have the following information to hand; order number, stock number and the reason for the return. We will email you back with instructions.

We will refund the price of the item and delivery charge (pro-rata to weight of order where necessary) to the purchaser or exchange the product once it is received by us.

If you choose to return any products to us without following our returns instructions, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service.

We reserve the right to terminate the customer account where refunds have been processed and goods are not returned to us.

Cancellation

If you are a UK/EU consumer, under the European Union’s Distance Selling Regulations, you have up to 7 working days after you have received your delivery to cancel your order. Please e-mail admin@nexrastore.com to inform us of your intention to cancel. Please note the following;

  • It may not always be possible to stop an order from being dispatched, as nexrastore endeavour to process orders as soon as possible.
  • Where delivery cannot be interrupted, please refuse any delivery of cancelled goods or post them back to us (unopened). You must take reasonable care of the goods all the time they are in your possession.
  • You can cancel your order if the goods have been lost in transit. We will refund the cost of the order and the delivery charge.
  • You will not be charged for returns in accordance with our standard returns process.
  • Your right to return goods does not apply to certain products, see below for more details about this.
  • Except in relation to faulty or incorrectly supplied goods where your statutory rights are unaffected, for reasons of hygiene nexrastore cannot accept return of:

    Any beauty items including toiletries, cosmetics, personal grooming, fragrances, hair accessories, millinery, scarves, wraps, perishable items or goods which have been made or ordered to a customer's specification.
  • European Union’s Distance Selling Regulations are applicable to EU member states.

Delays

Where the supply of your product(s) may be delayed or prevented for reasons beyond our control, we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

Definition of Order/Contract

The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on the Website by pressing the 'Place Order' button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.
  • We will send to you an order acknowledgement email detailing the products you have ordered. This is not an order confirmation or order acceptance from nexrastore.
  • As your product is shipped from our warehouse we will send you a despatch confirmation email.
  • Order acceptance and the completion of the contract between you and us will take place when we despatch the products, unless we have notified you that we do not accept your order, or you have cancelled it in writing to us before despatch.

 

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered is out of stock.
  • We cannot obtain authorisation for your payment.
  • We identify a pricing or product description error.
  • You do not meet the eligibility to order criteria set out in the main Terms & Conditions.

 

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

All card payments are subject to authorisation by your card issuer and we take payment when we accept your order shortly before dispatch. In some circumstances we reserve the right to deliver to the card billing address at all times if we believe this to be the most reliable and secure option at the time of despatch and this will constitute completion of your order.

Where your order has been rejected by the card processor, we reserve the right to cancel the order and terminate your account with us with immediate effect. We also reserve the right not to fulfil orders to locations we know to be unsafe, unsecure or have had noted suspicious activity in the past.

Once we terminate your account, this is permanent. We will terminate any additional accounts you may register with us in your name or at an address associated with your name.

If your payment is not received and you have already received the products you ordered from us, you must pay for the products or return those products to us in accordance with reasonable return instructions that we provide to you and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect (or arrange for collection) of the products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any products that are the subject of an unpaid order.

Your use of this Website

You must not use this Website in any way that infringes the rights of the owner (PurpleLilac Ltd) or that restricts or inhibits anyone else's enjoyment of the Website.

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You may use, download and print content on the Website solely for your own personal use. However, you may not, without our prior written consent, either copy, modify, reproduce, distribute, use, re-post or otherwise deal with any content on the Website. Neither must you, for any purpose, reproduce, crawl, frame, link to or deep-link into this Website on or from any other website or use the content of the Website for any commercial or community use whatsoever unless expressly agreed with PurpleLilac Ltd, owner of nexrastore.

Zero Tolerance

Our staff and suppliers have the right to be treated with dignity and respect at all times. We take a 'zero tolerance' approach to customers who engage in aggressive, threatening or bullying conduct or behaviour via telephone, email, social media or letter to our operatives or suppliers. Where this occurs, your account will be permanently terminated with immediate effect.

Once we terminate your account, this is permanent. We will terminate any additional accounts you may register with us in your name or at an address associated with your name.

Limitation of Liability

We will use reasonable efforts to ensure that this Website is free from viruses and other malicious or harmful content. However, we make no warranty that the Website will meet your requirements or will be uninterrupted or error-free, or that the site or the server that makes it available are free of viruses or bugs.

It is your responsibility to ensure that you have the right equipment (including antivirus software) to use the Website safely and correctly and to screen out anything that may damage or harm your computer.

We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

We have placed links on this Website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. We accept no liability in respect of the use of these websites.

We exclude all representations, warranties, conditions and terms (whether express or implied by statute, common law or otherwise) to the fullest extent permitted by law. We accept no liability for any special, indirect, incidental, consequential or economic loss however caused arising out of or in connection with these Website Terms or your use of the Website. These exclusions shall be governed by and construed in accordance with English law.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our agents.
